Chennai: The Madras High Court has given relief to Udayanidhi Stalin in the petition related to the controversial reference to abolish Sanatana Dharma.
The Madras High Court has dismissed a plea challenging Tamil Nadu minister and DMK leader Udayanidhi Stalin's continued tenure as a member of the Legislative Assembly.
Udayanidhi Stalin's controversial remark related to the case was on September 2, 2023. It was mentioned that Sanatanadharma should be eradicated like malaria and dengue.
The petition was against Udayanidhi Stal and Minister PK Shekhar and DMK MPA Raja who were present on the stage during the speech.
Justice Anita Sumanth observed that Udayanidhi Stalin had spread false information about Sanatana Dharma, but dismissed the petition challenging his continued tenure as a legislator.
At the same time, Udayanidhi Stalin was criticized by the Supreme Court for his controversial remarks about the abolition of Sanatana Dharma.
The Supreme Court criticized that the right to freedom of expression was misused. 'The right under Article 9(1)(a) and Article 25 of the Constitution is abused.
Are you currently exercising your right under Article 32? Don't you know the consequences of what you say? You are not an ordinary person. He is a minister. You should know the consequences', the bench had said.
The Supreme Court criticized Udayanidhi's plea that all the FIRs filed in different states on account of his remarks are one and should be considered together. The bench headed by Justice Sanjiv Khanna heard the petition. The case was adjourned to March 15.
